Job Description


About the Role

As Senior Legal Counsel, you’ll be part of the TPMC Legal Team, which manages the Technology, Payments, Marketing and Consumer workstreams. You will be a key point of contact for the business on all things marketing, including contracts, licensing, global campaigns, brand partnerships, copy clearance, and advertising rules. You will also be the team member responsible for ensuring ASOS.com’s compliance with consumer related rules and regulations on a global basis, including advising the business in areas such as consumer rights, digital markets/services regulations, green claim regimes, online practices regulations (e.g. dark patterns), pricing regulations and others.

Although a key part of the role will be marketing and consumer regulation, we are also looking for a team member who is keen to pick up work across the other areas of responsibility of the TPMC Legal Team (with prior experience in these areas being preferred but not a prerequisite for the role).

This role will support the Head of Legal for the TPMC Team and will supervise the more junior members of that team. However, there will also be the opportunity to support other Heads of Legal on matters outside of these areas, including Commercial/Retail and Supply Chain matters where capacity allows. We work in a highly collaborative environment, presenting numerous opportunities to enjoy a huge variety of often innovative legal and commercial challenges.

The role is critical in helping the wider ASOS Legal Team meet the needs and requirements of all elements of ASOS’ business across the globe, requiring the ability to give commercial as well as legal advice, often on cross-border matters, and to promptly identify risks and issues that need to be escalated within the company.

The role requires someone who is hands-on and commercially minded, with a strong professional ethic and the energy, interest and training to pursue a broad array of consumer, commercial, legal and risk/reputation management matters. Communication is key, as our team members continually build relationships at all levels across the business.


What You’ll be Doing

Marketing, Commercial and Reputation

  • Working collectively with the Procurement Team, provide appropriate legal support and assistance to all departments in the business on a broad range of commercial contracts including adtech, affiliate relationships, brand partnerships, public relations and creative agencies, whilst ensuring that all critical commercial and regulatory requirements (such as data protection) are appropriately covered.
  • Negotiating contracts and IP rights relating to marketing and customer-facing projects, including projects with a wide array of social media influencers.
  • Working closely with marketing and media teams across ASOS to ensure that ASOS’ global marketing campaigns and commercial partnerships are compliant with relevant advertising regulations across multiple territories, including copy clearance, managing any ASA or CMA complaints related to advertising and ensuring the ASOS websites are up to date at all times.
  • Responsibility for the maintenance and development of agreement templates and contract playbooks.
  • Dealing appropriately and efficiently with any brand reputation issues alongside the ASOS press team.

Consumer

  • Working closely with marketing, trade, commercial and pricing teams across ASOS to ensure that ASOS’ consumer impacting initiatives are compliant with relevant consumer regulations across multiple territories.
  • Responsibility for copy clearance, managing regulatory and consumer complaints/litigation, drafting consumer communications, advising on website copy and ensuring the ASOS terms and conditions are up to date at all times.
  • Global horizon scanning of upcoming consumer regulation and interpreting and implementing consumer regulation across the ASOS site. Project managing the implementation of consumer regulation across a variety of internal business stakeholders.
  • Instruct and liaise with local counsel in our international markets.

Tech

  • Review, drafting and negotiation of the full range of Tech contracts for software development and licensing, SaaS, PaaS, HaaS, service level agreements, telecoms, consultancy services, outsourcing and hardware provision. Providing specialist sector knowledge and expertise on the Tech aspects of other contracts and negotiations.
  • Advising on the implementation of Tech programmes – i.e. for Retail (e.g. Retail Management Systems), Supply Chain (e.g. Warehouse Management Systems), Finance (Finance System) and our People Team.
  • Work closely with our Tech Teams to assist with the development of ASOS’ various ecommerce offerings (website, mobile-web, apps, etc) and advise on new technologies, including opportunities and inherent risks.
  • Able to support the due diligence and commercial analysis for start-up partnerships and/or acquisitions and proof of concept phases for new technology.
  • Provide informed insights and updates on relevant Legal developments to the Tech community and be a recognised Tech expert in Legal.
  • Identify areas of leverage and opportunities for improvement in existing processes and procedures.

Team & Management

  • You will report to the Head of Legal for TPMC and will have the opportunity to work closely with our General Counsel and Company Secretary.
  • You will be responsible for managing more junior members of the team so people management skills are a prerequisite.
  • Build and maintain strong relationships with internal stakeholders and external counsel.
  • Manage legal and commercial aspects of critical projects.
  • Identify the need for external legal advice and escalate legal matters accordingly.
  • Identify and help to prepare and deliver training to the Legal team and to the business on relevant legal and commercial issues.
  • Be the key point of contact to drive projects forward with multiple stakeholders.

Qualifications


Who We’d Like to Meet

  • General commercial, marketing and consumer legal experience (technology and/or payments related experience would be a bonus, but not essential), gained from private practice or in-house positions.
  • Will suit someone who loves job variety, ecommerce retail, consumer regulation and innovative tech.
  • 6-8 year PQE Qualified Solicitor with experience as a guide.
  • Adopts an approachable and adaptable manner to ensure excellent communication and interaction with the wide variety of different people and personalities within the unique environment of ASOS, across all levels and geographies.
  • Has energy and drive to succeed.
  • Has previous experience working in a fast-paced, growing, agile, adaptable in-house commercial environment.
  • Possesses excellent IT skills, particularly in relation to the use of Sharepoint, Word, Excel and PowerPoint, and ideally an enthusiastic early adopter of new technology generally.
  • Is an excellent communicator, as our Legal team members continually build relationships at all levels across the business, at the same time as working together to deliver what’s needed by the business.
  • We’re also fast paced, so all team members also need to be adaptable and cope with change quickly and be enthused and excited about what’s around the corner for us.
